These Terms & Conditions apply to the use of this website and to purchases made from Cherry Acres Animal Housing.
By using this website or placing an order with us, you agree to these Terms & Conditions. Nothing in these Terms & Conditions affects your statutory rights as a consumer.

We make reasonable efforts to ensure that information, photographs, dimensions, specifications and descriptions on our website are accurate. However, minor variations may occur, particularly as our products are handmade and timber is a natural material.
It is your responsibility to ensure that any product, service or information available through this website is suitable for your requirements.
The design, layout, appearance, graphics, photographs, text and other content of this website are owned by or licensed to Cherry Acres Animal Housing unless otherwise stated. Reproduction or unauthorised use is prohibited.
Any third-party trademarks appearing on this website are acknowledged as belonging to their respective owners.
Our website may contain links to third-party websites. These links are provided for convenience only and do not constitute endorsement. We are not responsible for the content or availability of third-party websites.
3. Products and Specifications
Our products are handmade and built according to the specifications and options stated on our website and/or agreed with you when your order is placed.
If you require any modification, alteration, custom size or other change to the advertised specification, this must be agreed with us in writing before the order is placed.
Because timber is a natural material, variations in grain, colour, knots, texture and appearance are normal. Timber may also naturally expand, contract, split, shrink or warp as environmental conditions and moisture levels change. Such natural characteristics are not necessarily defects.
Product photographs are illustrative. Natural timber products and handmade items may vary slightly in appearance from photographs shown on the website.
Dimensions stated on our website are approximate unless expressly stated otherwise.
4. Customer Requirements Before Ordering
All dog kennels, rabbit housing and other buildings requiring installation must have a suitable, solid and level base prepared before delivery and installation.
It is the customer's responsibility to ensure that:
the base is suitable, solid and level;
sufficient space is available for the product;
there is safe and adequate access to the installation location;
any gates, paths or other access routes are sufficiently wide;
there is adequate parking for our delivery vehicle, which may be a long-wheelbase commercial vehicle; and
any necessary permissions or consents have been obtained.
Our installation teams will not normally transport products or product components through a customer's house or other unsuitable access route.
Where delivery is made by pallet or third-party courier, suitable access must be available for the delivery vehicle and pallet.
Any advice we provide regarding product suitability, bases, positioning or access is general guidance unless we have expressly agreed otherwise in writing.
If we are unable to complete delivery or installation because suitable access, parking, space or a suitable base has not been provided, additional delivery, installation or return-visit charges may apply.
5. Prices and Payment
All prices displayed on our website include UK VAT at the applicable rate unless otherwise stated.
The price payable is the price agreed when your order is accepted, including any delivery, installation or optional extras shown or agreed.
Full payment is normally required before manufacture commences unless we have agreed otherwise in writing.
Where we agree to accept a deposit, the balance must be paid before manufacture commences or by any other date agreed with us.
Any provisions concerning deposits or cancellation are subject to your statutory consumer rights.
6. Lead Times
Our products are generally built to order.
Any manufacturing or delivery lead time given on our website, quotation, order confirmation or correspondence is an estimate unless we expressly agree a fixed delivery date with you.
Our usual estimated lead time may be approximately four weeks, although this can vary according to demand, product specification, painting or finishing requirements, material availability and circumstances outside our reasonable control.
We will provide or confirm a delivery date when reasonably possible.
We will contact you if we become aware of a significant delay.
Nothing in this section affects any statutory rights you may have concerning delivery of goods.
7. Delivery and Installation
Where installation is included, our delivery team will normally deliver and assemble the product at the agreed location.
We may take photographs of the installation area and base before installation and photographs of the completed product after installation. These photographs may be retained as evidence of the condition of the site and product at the time of delivery and installation.
You, or another responsible adult authorised by you, should be available to accept the product upon delivery.
We may ask you to sign confirmation that delivery and/or installation has taken place.
Signing a delivery or installation document does not affect any statutory rights you may have in relation to faults that were not reasonably apparent at the time of delivery.
We may use a third-party courier for certain orders. Where packaging or goods show obvious signs of significant damage upon arrival, you should notify the courier and us as soon as reasonably possible and, where appropriate, refuse delivery.
Acceptance of a delivery does not remove your statutory rights in relation to faulty, damaged or incorrectly supplied goods.
8. Parking and Access
Where installation is included, you must provide reasonable and safe access to the installation area and adequate parking for our delivery vehicle.
Where delivery is made by courier or pallet network, suitable vehicle access must be available.
If delivery or installation cannot reasonably be completed because of inadequate access, parking, an unsuitable base or another condition at the property for which you are responsible, we reserve the right to charge reasonable additional costs incurred in rearranging delivery or installation.
9. Moving or Relocating Products After Installation
Where Cherry Acres Animal Housing has delivered and installed a product at an agreed location, our guarantee applies to the product as installed at that location, subject to the other terms of this guarantee.
If the product is subsequently moved, dismantled, repositioned, relocated or reinstalled by the customer or any third party, our guarantee will not cover any defect, damage, deterioration, structural issue, alignment problem, water ingress or other problem arising after or as a result of that movement, dismantling, relocation or reinstallation.
Cherry Acres Animal Housing accepts no responsibility for damage or other issues caused by moving, lifting, dismantling, modifying, repositioning or reinstalling a product following our original installation.
This includes issues caused by the condition, level, drainage or suitability of the new base or location.
If you wish to relocate one of our products, we recommend contacting us before doing so.
Nothing in this section excludes or limits any statutory rights that cannot legally be excluded or limited.
10. Changes After Installation
Once a product has been delivered and installed in accordance with the agreed order, we are not obliged to make alterations or modifications simply because the customer subsequently wishes to change its specification, position, design or configuration.
Any alterations requested after delivery may be chargeable and are subject to our agreement.
Unauthorised alterations or modifications may affect our guarantee where they cause or contribute to a subsequent problem.
11. Cancellation Rights
Your cancellation rights depend upon the nature of the product ordered and the circumstances in which the contract was entered into.
For standard products purchased online or at a distance, you may have cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
However, the statutory right to cancel does not normally apply to goods that are made to the consumer's specifications or are clearly personalised.
Many of our products can be made or modified specifically for an individual customer's requirements. Where a product is genuinely bespoke, customised or made to your specifications, the statutory 14-day cancellation right may therefore not apply.
Where a statutory cancellation right does apply, we will honour that right in accordance with applicable consumer law.
Please contact us as soon as possible if you wish to cancel an order.
Cancellation of an order does not affect your statutory rights where goods are faulty, not as described or otherwise fail to conform to the contract.
12. Returns
We take care to provide high-quality handmade products.
Where you have a statutory right to return or reject goods, these Terms & Conditions do not restrict that right.
For non-faulty goods where no statutory cancellation or return right applies, particularly bespoke or personalised products, we are not obliged to accept a return.
Where a return is agreed outside your statutory rights, the conditions and costs of that return will be agreed with you.
13. Faulty, Damaged or Incorrect Goods
If you believe your product is faulty, damaged or does not correspond with your order, please contact us as soon as reasonably possible.
We may ask you to provide photographs or other reasonable evidence so that we can assess the issue.
Depending upon the circumstances and your statutory rights, we may inspect the product and, where appropriate, repair or replace it or provide another remedy required by law.
Where practical, we will normally seek to rectify a problem at the product's installed location.
Nothing in these Terms & Conditions limits your rights under the Consumer Rights Act 2015.
Damage or deterioration resulting from misuse, accidental damage, neglect, inappropriate maintenance, unauthorised modification, relocation, an unsuitable base, or circumstances occurring after delivery which are not attributable to us will not normally constitute a product fault for which we are responsible.
14. Our Timber Guarantee
Unless otherwise stated, timber used in our products is covered by our 2-year guarantee against rot, commencing from the date of delivery.
The guarantee does not cover:
normal wear and tear;
accidental or deliberate damage;
misuse, neglect or mistreatment;
damage caused by animals;
damage caused by severe or exceptional weather conditions;
failure to maintain or treat the product appropriately where maintenance is reasonably required;
damage caused by an unsuitable, unstable or unlevel base;
standing water or inadequate drainage;
unauthorised alterations or modifications;
damage arising from moving, dismantling, relocating or reinstalling the product after its original installation; or
natural characteristics and movement of timber, including variations in colour and grain, knots, minor splits, shrinkage, expansion and warping that do not amount to a defect.
The guarantee is provided in addition to, and does not replace or restrict, your statutory rights under the Consumer Rights Act 2015.
15. Complaints
If you have a complaint or believe there is a problem with your order, please contact us in writing at:

Please provide your name, order details, a description of the issue and, where relevant, photographs showing the problem.
We will investigate complaints and seek to resolve them within a reasonable period.
16. Liability
Nothing in these Terms & Conditions excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
We are not responsible for losses caused by circumstances outside our reasonable control or for damage caused by misuse, neglect, modification, relocation, an unsuitable installation area or failure to follow reasonable care and maintenance instructions.
17. Events Outside Our Control
We will not be responsible for delays or failure to perform our obligations caused by events outside our reasonable control.
Such events may include severe weather, road closures, vehicle breakdowns, supplier or material shortages, industrial action, accidents or other circumstances that could not reasonably have been anticipated or avoided.
Where such circumstances affect a scheduled delivery or installation, we will contact you and arrange an alternative date where necessary.
18. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
19. Governing Law
These Terms & Conditions and any contract between you and Cherry Acres Animal Housing are governed by the laws of England and Wales.
If you are a consumer, you will retain any rights you have under applicable consumer law regarding where legal proceedings may be brought.
20. Statutory Rights
Nothing in these Terms & Conditions is intended to exclude, restrict or reduce any rights you have under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or any other applicable consumer protection legislation.
